Terms and Conditions of E-Shopping

1. APPLICATION OF TERMS AND CONDITIONS OF SALE

The following terms and conditions shall govern the sale by the entity ("AVB" or "Seller") named on the invoice that will be provided to Customer for orders for computer systems and/or related products sold by AVB, unless Customer has signed a separate formal purchase agreement with AVB.

By ordering products on AVB's on-line store or by accepting delivery of the products described on the invoice, Customer agrees to be bound by and accepts these terms and conditions. AVB reserves the right to change these terms and conditions without prior written notice at any time, at AVB's sole discretion.

2. OTHER DOCUMENTS DO NOT APPLY

These terms and conditions may not be supplemented, altered or modified by the use of any other document(s). Any attempt to modify, supplement or amend these terms and conditions will be null and void unless agreed to in writing by AVB.

3. PAYMENT TERMS

Terms of payment shall be determined at AVB's discretion and otherwise agreed to by AVB. Payment must be received by AVB prior to AVB's acceptance of Customer's order. Payment shall be made by credit card, check or some other pre-arranged method of payment acceptable to AVB.

Where payment is made by credit card, such payment is subject to the approval of the financial institution issuing the credit card.

4. PRICES, SHIPPING AND HANDLING CHARGES AND TAXES

AVB will only ship to U.S. locations. All prices on the website do not include charges for shipping and handling, and taxes. Separate charges for shipping and handling will be shown on the invoice. AVB is obligated to withhold sales tax for delivery within California. Unless Customer provides AVB with a valid and correct tax exemption certificate applicable to the product ship-to location prior to AVB's acceptance of the order, the Customer is responsible for sales and all other taxes associated with the order.

5. LIMITED WARRANTY

One Year or 180 Days Limited Warranty

AVB warrants that the product purchased from AVB Online Store is free from any defects in materials or workmanship for the period of one year or 180 days depends on the product warranty card included in the box. If such a defect is discovered within this warranty's limitations, AVB agrees to repair or replace this item, at its sole discretion, with the same item or one of equal value, free of charge to the original consumer purchaser.

This warranty shall not apply if this product is modified, misused, tampered with, subjected to abnormal working conditions, or transferred to someone other than the original consumer purchaser.

6. PRODUCTS AVAILABILITY

Product availability may be limited. Products may not be available for immediate delivery. AVB reserves the right, without liability or prior notice, to revise or cease to make available any or all products or to cancel any order. If there is any revision or cessation, AVB may ship products which have the functionality and specifications of the products ordered but there will be differences in the specifications between what was shipped and what was ordered.

7. GOVERNING LAW AND JURISDICTION

The sale of products shall be governed by the laws of the State of California excluding the conflict or choice of law provisions. Venue and jurisdiction for all disputes will lie in exclusively Los Angeles County, California.

8. EXPORT CONTROL

Products purchased or received under these terms and conditions shall be subject to export laws and regulations of the United States of America.

9. RETURN POLICIES

We want you to be satisfied with every purchase, and we will make every effort to resolve any problem you may have.

All products (unless noted on our site) are sold with the full AVB warranty as described in #5. This return policy below is only available for customer purchase AVB products from the AVB E-Shopping. Customer may return the product only in accordance with AVB's return policy in effect on the date of the invoice. The following terms will apply:

1. AVB will offer a refund or replacement within 30 days of purchase.
2. Unless it is defective, hardware that is returned for a refund will be subject to a 15 percent restocking fee and the additional shipping charges are your responsibility.
3. In order to receive full credit, your purchase must be returned with shipping prepaid. AVB cannot accept items with shipping charges COD. All items must be in "as-new" condition, in original packaging and with all warranty cards, manuals and accessories. Any discrepancies are likely to result in a full or partial forfeiture of your credit.
   

Required Return Procedures

1. Before returning any item for any reason, Customer must e-mail AVB returns department at info@avbusa.com for a Return Merchandise Authorization (RMA) number.
2. Customer should furnish the following information in the email:
   • Order number
   • Product number and/or product name
   • Reason for return
   • Return for replacement, or refund

AVB customer service representatives will contact the Customer with the Return Merchandise Authorization number (RMA) and return instructions via e-mail after the request for RMA is received.

10. GUIDELINE TO RETURN THE ITEM

1. Customer must write the given RMA number on the outside of the package.
2. All items must be in original condition with all packing materials, manual, software, warranty card, and registration card(s).
3. Return your package to the address listed below:

4. Customer should send the returned package(s) via UPS Ground, FedEx Ground or other Ground service with tracking information. AVB is not responsible for lost/misdelivered/misdirected package. It is also advised that Customer email AVB for the tracking information.
5. All items returned must be received by AVB warehouse within 10 business days after an AVB representative e-mail the RMA number and return instructions to the customer. A delay in sending the product back will result in a delay or complete forfeiture of your credit.
6. If Customer return the product(s) back for credit, all return shipping is to be paid in full by the customer. If Customer return the product(s) for replacement, return shipping must initially be paid by the customer. AVB will refund shipping costs if the return product is originally defective.

11. SHIPPING POLICIES

For your convenience, AVB provide you with 4(four) different ways to ship your order:

Shipping charges are automatically calculated for you when placing an order based on the total weight of the all the items that you order.

-DHL EXPRESS Delivery (Weekdays only) Unless specified, we ship all orders via DHL EXPRESS Delivery for US$12.00 (item up to 3lbs). Heavier items are an additional US$2.00 per pound in excess of 3 pounds. Order must be placed before 10:30 a.m. Pacific Time to guarantee same-day shipping.

-Fedex Ground, UPS Ground or USPS are just US$4.95 per order up to 3 lbs. For orders over 3 lbs. shipping is US$4.95 plus US$1.00 per pound or fraction thereof.

Please Note:

• We do not ship or deliver on weekend or major holidays.
• Goods are only available for U.S. territory (Alaska, Hawaii, and Puerto Rico are not included).
• We cannot deliver to P.O. Boxes, APO/FPO addresses, U.S. Territories, or international locations.
• Shipments are subject to stock availability
